1 – Purpose

 

The general terms and conditions of sale herein (hereafter the “General Terms & Conditions” or “GTCs”) are applicable to all sales transactions and data usages made or conducted between Rektro a wholly owned subsidiary of BLUE 14 D2C; Limited Company Number 11552224; registered at 36, Vine Street Brighton; VAT no. 304 2926 27 (hereafter “Rektro” or “The Company” or “We” or “Us”) and any consumer within the meaning of the provisions of the Consumer Contract Regulations (2013), aged 18 years old or more and legally competent (hereafter the “Customer”, the “User” or “You”) at the time of making an order by telephone, by post or via the website http://www.rektro.com (hereafter the “Website”).

Any order made implies acceptance of the prices and the GTCs in the version effective at the time of formation of the contract (that is to say at the time of the order).

Rektro remains free, at any time, to enhance, amend, correct or delete all or part of the General Terms & Conditions.

2 – Products and Offers

 

Products presented for sale are described in product descriptions to be found on each item label.
Although the photographs and images represent a likeness of each item, some colour differences may appear due to the IT and print media in which they are seen. The sizes available are clearly listed in UK sizes. A size guide is available on the Website. Products sold by Rektro are compliant with the UK and EU regulations in effect.

Promotional offers on the products sold are not permanent. The dates of validity and the terms of the offers proposed to the Customer are clearly communicated on the Rektro Website and on The Company’s promotional materials.

The validity of these offers is also subject to availability. Despite the best efforts of the company, from time to time demand may exceed supply. In the event of unavailability of items, Rektro will endeavour to contact the Customer without delay.

In the event of the ordered item being out-of-stock and thus unavailable, Rektro will endeavour to offer to the Customer a suitable replacement, at the nearest possible price to the item originally ordered. If however the item is not acceptable to the Customer, they may return it according to the provisions of article 6 of the GTCs and, upon presentation of a receipt for the cost of return (postal receipt), the Rektro Customer Services will refund this cost.

 

3 - Order confirmation

 

Orders can be placed by the Customer either by telephone, by post or via the Website. Offers are valid as long as they are visible on the Website, or for the period indicated in the promotional materials.

For orders by telephone: a purchase order is made between Rektro and the Customer upon order confirmation by The Company’s Customer Services operator.

For orders by post: a purchase order is made between Rektro and the Customer upon receipt of a completed order form by Rektro.

For orders via the Website: The purchase order is made between Rektro and the Customer when the Customer clicks the order button, having checked the contents of the shopping cart and the total cost of the order and after having read and accepted the GTCs, brought to their attention by means of a link appearing on the confirmation page of the shopping cart, to which they agree by ticking the box “I accept and acknowledge the General Terms & Conditions for Rektro.

For orders made via the Website, the Customer will receive an e-mail confirming the receipt of their order. Upon which, their order will be processed and dispatched. This confirmation e-mail includes:

1. A recap of the main points of the contract, i.e. the items ordered, their price, the cost of delivery, the delivery address and billing address;
2. A link to the GTCs in effect at the time of contract agreement, in particular any information relating to the right of cancellation as well as the execution of the contract (guarantees, contact details for any claims or complaints);
- wherever relevant, an indication of the period during which, or the date at which, the separate components for the product(s) included in the contract will be available.

It should be noted that when the Customer chooses to settle their purchases by cheque, the contract will not be completed between Rektro and the Customer until receipt of cleared funds in The Company’s bank account.

 

 

4 – Prices and Payment

 

The prices of products are always those indicated thus:

  1. On The Company’s promotional materials;
  2. On the Rektro Website at the time of order.
  3. Prices are inclusive of VAT and exclusive of delivery costs.
    Delivery costs at the Customer’s expense are indicated on the order forms and on the Website. For the United Kingdom mainland, Northern Ireland, the Channel Islands and the Scottish Highlands and Islands, delivery options and the associated costs are as follows:
  4. “Standard” 2 to 3 day delivery costs to a home address at the Customer’s expense: £3.99. Home delivery (excluding the “express” option) represents the standard method under the terms of the Royal Mail's Small Packet delivery or equivalent service.

Delivery to Mainland Europe that is any part of the EU, Scandinavia: £5.99. Rest of World: £6.99. Any returns are to be made at the Customer’s expense, unless otherwise stated by the Company or a member of Rektro’s staff.

The payment methods available to Customers are indicated on the Rektro order forms and on the Website. For the United Kingdom:
Order settlement can be carried out with a valid credit or debit card bearing the Visa, Eurocard, Mastercard, American Express) Applepay or PayPal or bank cheque made payable to Rektro.

For payment with a bank credit / debit card, the Customer communicates the 16-digit card number, the expiry date and the 3 figures shown on the back of the card next to the signature (cryptogram). The Website is PCI compliant and uses a secure payment method such as SSL (Secure Socket Layer). The bank details are fully encrypted and don’t circulate clearly over the internet network, which along with all other methods of card payments, are PCI compliant.

 

 

5 – Delivery and Claims

 

Parcels are transported and distributed by the Royal Mail or an equivalent postal operator for standard dispatches in the United Kingdom.


The delivery times indicated on the Website and on promotional materials are the usual average times for the handling of an order, its dispatch and transit. They are only given as an indication. For orders made via the Website, the maximum delivery time is 10 days from the time of order for standard dispatches. For orders made by post, the maximum delivery time is 7-14 days from the time of order for standard dispatches.

Delivery is deemed complete upon provision of the product to the Customer by the courier at the delivery address given by the Customer.

Rektro will not be held responsible for any delays related to events that are out of their control such as strikes or any force majeur. Such events do not confer the Customer with the right to cancel the sale, to refuse products or to claim damages.

6 – Returns, Refunds and Cancellation

 

6.1 Returns and refunds

Rektro allows the Customer to return ordered items, within thirty (30) calendar days from their date of reception.

To do so, they must send the return form along with the receipt or bill of purchase accompanying the parcel. As such, if the item is unsuitable, the Customer may exchange it or obtain a refund. The Customer’s statutory rights are not affected.

Returns by postage due or against reimbursement, as well as damaged or incomplete goods will not be accepted, unless by prior agreement with The Company or its staff..

Customers claiming returns will send products to Rektro at the following address:

Products must be returned in their original condition and packaging, as delivered to the Customer, and must not present any signs of damage, disassembly, installation or use.
Freight costs will be borne by the Customer.
Rektro will proceed with the reimbursement of return costs upon request, against receipt, only in the event of a faulty item or an error in dispatch attributable to The Company.
Refund or exchange will be carried out within 30 days from the date of receipt of the returned parcel.

6.2 Cancellation / withdrawal of an order  

The Customer Contract Regulations (2013) allows the Customer to exercise a right of cancellation within a 14 day-period. In which case, from the time of receipt of goods the Customer may inform Rektro of their decision to cancel, without being required to give any justification or to pay any penalty fee, according to the following procedures:

- By returning goods with the appropriate returns form

- By clearly informing Customer Services by letter, e-mail or telephone (0333 030 7273 (Calls to 03 numbers cost no more than a national rate call from a landline. Refer to your service operator for mobile phone charges). Open Monday to Friday from 8 a.m. to 6 p.m. Saturday, Sunday and Bank Holidays from 9 a.m. to 4 p.m. (Closed Christmas and Easter Day).

Under these circumstances, the Customer will then have a further 15 calendar days to return the goods to Rektro following communication of their decision to cancel addressed to the latter.

Products must be returned in their original condition and packaging, as delivered to the Customer, and must not present any signs of disassembly, installation or use.

The Customer expressly recognises that the right of cancellation does not apply, in particular, to unwrapped products that cannot be returned for sanitary reasons, personalised or customised goods, or audio and video items once they have been unsealed.

Exercising the right of cancellation under the aforementioned terms confers the right, for the Customer, to refunding of the sums paid, including initial delivery costs (standard tariff), within 15 days from the date at which Rektro is made aware of the Customer’s decision to cancel or return. Should the delivery costs concern a fixed sum, independent of the number of items delivered, Rektro will not refund these initial costs (standard tariff) in the event of partial cancellation involving only a portion of the products ordered.

The refund may however be delayed until recovery of the products or until proof of dispatch of said products is provided, the date of reference being the first of these two occurrences.
Any return shipping and transport costs will be borne by the Customer. 

7 – Guarantees

7.1 Legal Guarantees

When acting upon legal guarantee of conformity, the Customer:

1. Benefits from a 90 day period from the date of delivery of the product to take action;

2. May choose between the repair or the replacement of the product, unless the Customer’s choice implies a significantly disproportionate cost with regard to the other procedure, in view of the value of the goods in question or of the extent of the defect. Should repair or replacement prove impossible, the Customer may then decide whether or not to keep the product and to request a partial refund of the price;

3. Is dispensed from providing proof of the existence of a conformity defect with the product.

Additionally, the legal guarantee of conformity applies independently of any commercial guarantee potentially agreed upon. The Customer can decide to implement this guarantee against hidden defects of the sold item. In this situation, the Customer may choose between termination of the sale or the reduction of the sale price to a level that is acceptable to them and The Company.

 

7.2 Commercial Guarantees

Certain products (eg promotional premia, such as watches, alarm clocks etc.) carry an extended guarantee with regard to the legal guarantee. In this case, it will be clearly mentioned in the technical description of the item and the terms under which the guarantee operates will be communicated to the Customer upon delivery of the product.

NB Guarantees do not apply to the normal wear and tear of goods, nor in the event of misuse or neglect.

  

8 – Liability

Despite all the efforts made for the composition and updating of the Website, errors, inaccuracies or omissions may still persist, as well as problems with connecting to the Website or interruptions to the connection.

Rektro declines all liability with regard to any damage, direct or indirect, that may ensue.

Via hypertext links, you are able to visit other websites. The Company be held liable for the content of other websites to which these hyperlinks refer you and over which they have no control.

 

9 - Intellectual property and related rights

The designs, products and contents of catalogues and promotional materials addressed to the Customer by Rektro, the Website and all the elements that compose it, in particular the different content (photos, texts, presentations, brands, drawings and models, etc.), the associated software, are protected by intellectual property rights and related rights, reserved for the sole holders of those rights.

Consequently, any use, reproduction, representation or distribution, partial or total, of these elements is strictly forbidden with the specific exception of copies, without modification or change, made for the purposes of personal and private use, pursuant to English Intellectual Property Law.

 

10 – Personal Data, Cookies and Privacy Policy

10.1 Personal Data
Rektro wants to make sure Users can keep control of their personal data. To do this, the User can modify their preferences for phone email and direct marketing communications and how their personal data may be processed contacting Customer Services Team below or by clicking
here or sending us an email to privacy@Rektro.com . The User also has the right to be informed of how their personal data is used and processed. The User has the right to access and to rectify the personal data held by Rektro. The User can request to receive this personal data In a commonly used and machine readable format. The User can also request for any personal data to be erased on the understanding that Rektro will no longer be able to provide the level of service expected.

What information does Rektro collect and why?

The Company collects data directly from customers and Users when an order form or a registration is placed on the Rektro Website, or via a completed paper or telephone order.

Rektro uses cookies to collect information about Website traffic and usage. The Company also collects information about Users computers, their Internet connections, operating systems and domains. If a User has arrived at the Rektro site via a link from another website, the Company will collect information about the URL of the link in page. This information may include :

  1. Personal data which includes name contact details payment details and any transactional information.
  2. Any information that User includes in the correspondence sent to the company. Website usage information such as the User’s IP address, browser type, page views and information about use of the Rektro Website.

The purpose of Rektro’s collection of personal data is to:

  1. Manage the User’s account, their profile and any purchasing activity.
  2. Deliver a good service and always strive to improve it.
  3. To provide the User with information on products and services that have been requested and other information and offers that Rektro believes will be useful.

The purpose of collecting data on the Rektro Website usage and traffic data is to :

  1. Understand the way users interact with the Rektro Website.
  2. Enhance the Company’s Website design layout, functionality and the User’s experience as a whole.
  3. Ensure Users enjoy relevant products and services on offer.

How does Rektro use User data and for how long do the Company keep it ?

When a User orders a Rektro product, the Company processes that Customer’s personal data to manage their account, and to fulfil and manage their orders. The basis on which Rektro processes Customer’s personal data in this regard is to fulfil any contractual obligations as a vendor to them.

Pursuant to UK and European Economic Area data protection and freedom of information legislation, the Customer has a right of access and rectification of information concerning them. Under the Terms of these laws, the Customer can also challenge and oppose the treatment and use of this data. The terms for exercising this right are stipulated in the “ “Privacy Policy” in section 10.2. The Customer may exercise their rights according to one of the following procedures:

- by accessing the “My Account” section of the Rektro Website;

10.2 Privacy Policy

When a Customer grants Rektro permission, the Company will use that Customer’s contact details such as email, postal address or phone number to communicate information that the Company believes will be of legitimate interest to that Customer. Such information may include promotions, offers, new products and service updates. The basis on which Rektro processes personal data in this regard is only when it has been granted the Customer’s full and relevant consent.

When Rektro is given the relevant permission by the Customer, the Company will share the Customer’s email, postal address or phone details with other organisations owned by the same Parent Company, BLUE 14 D2C Ltd and other carefully selected partners for up to 5 years. The basis upon which Rektro shares this data is with the Customer’s full consent. If the Customer does not wish to receive any communications from third parties, they can click on the unsubscribe link at the bottom of each email, by contacting our Customer Service centre noted in section 10.1 above or by updating their preferences in My Account on the Rektro Website.

There are other instances in which Rektro may process Users and Customers personal data and they are listed below as follows:

  1. Where processing enables the company to enhance, modify, personalise or otherwise improve services and communications to its customers.
  2. To identify and prevent fraud.
  3. To enhance the security of the Company’s network and information systems
  4. To better understand how Customers interact with the Company’s websites.
  5. To determine the effectiveness of promotional campaigns and advertising activity.

The basis by which Rektro processes Customer data in the manner described above is for the Company’s legitimate business interest. Whenever Rektro processes data for legitimate business interest purposes, we will always ensure that customers personal data rights are protected. Rektro may process and retain customers personal data for up to 7 years after the last transaction with the company.

In return, the Customer endeavours to communicate accurate name, address, email address and other contact information, which they may or may not have granted permission for that data to be used for promotional purposes, is also accessible by the Company, which as such is acting in its Legitimate Interest, From the time this data has been provided by the Customer and indicated that it can be used by the Company, if there is a problem of sending or receiving mail electronically or via the post as a result of a move, transfer or closure of the mail or email account, then the company, acting in its Legitimate Interests, may use any remaining contact within its means to contact the customer.

Customers have the right to object to this process and if they wish to do so they should please contact the Rektro Customer Services Team, the details of which are noted in section 10.1 above or send an email to Privacy@Rektro.com. Customers should bear in mind that if they object to usage of data for legitimate business interest reasons then this will affect the Company’s ability to carry out certain tasks and services that benefit the customer.

Rektro may share Customer information with other BLUE14 D2C companies and suppliers to fulfil any contractual obligations to customers for the purposes described above. Retro, BLUE14 D2C Group companies operate and work with companies throughout the world. If customer data is transferred to countries outside of the European Economic Area (EEA), that personal data Will be protected by the same standard general data protection regulations (GDPR).

Rektro informs the customer of their rights to register with the Telephone Preference Service (TPS), which protects those on its registry from contacted by cold calling or any other form of unrequested telephone solicitation by The Company or any Third Party. Rektro is in no way responsible to administer registration of the TPS or to update it on behalf of or for any of its Customers.

10.3 Cookies

A cookie is a small file which is placed on the User’s hard drive or mobile phone / tablet preferences during a website visit. This file enables the user to move quickly around The Rektro Website. It is also designed to identify returning users. Rektro also uses a cookie to track a user’s sessions and preferences. The Company uses this information to find out which products and website features are the most popular and to utilise this information collected to show the user relevant content in the future.

Users can opt out of cookies by rejecting this request by Rektro, when they first visit the Company Website or by sending us an email to privacy@rektro.com (link).

To be able to provide the best possible level of service, Rektro uses reputable third-party re-marketing solutions to advertise across the Internet. The solutions will display advertisements to Users based on what parts of the Rektro Website they have viewed by placing a cookie on their web browser. This cookie does not in any way identify Users or give access to their computer or other devices. The cookie is used to indicate which other websites that the User may have visited, or a particular page so that Rektro can show the User offers and adverts relating to that page. Re-marketing solutions allow Rektro to tailor its marketing better to suit Users needs and display advertisements that are more relevant to them. If Users who visit the Rektro Website, don not wish to generate such remarketing cookies, they can opt out in the following ways:

Rektro uses reputable third-parties to deliver emails. These third-parties use unique identifiers and invisible images, often called pixel tags or clear GIFs to perform message opening sensing, message format sensing and click through sensing on behalf of the Company to bring Users more relevant information and offers.

Users have the right to opt out of cookies and pixel tags. If they wish to do so please click here or send the Company an email to privacy@rektro.com .

 

11 – Environment

We remind our Customers that waste materials from electric and electronic equipment cannot be thrown away with unsorted household waste. Indeed, this equipment contains dangerous substances that have a potential impact on the environment and human health.
For your information, appropriate collection points exist for the treatment, the reuse and the recycling of this type of waste.

In the context of a purchased product, the Customer may return any used electric or electronic device to Rektro at the following address: Rektro Returns Department, Unit C, Empress Park, Empress Road, Southampton, SO14 0HH

The cost of sending these products is borne by the Customer.

In doing so, the Customer participates in the preservation of the environment and the protection of human health.

 

12 – Applicable Law and Disputes

The present GTCs and all the operations mentioned herein are subject to English Law.
